These Terms and Conditions are agreed by both parties – the INXY.HOSTING project (INXY LTD. Reg № HE354067 12 Agias Zonis str., 4th floor, Suite 401, 3027, Limassol, Cyprus) and the Customer as soon as the latter agrees to purchase Services from INXY.HOSTING. By ordering any service from INXY.HOSTING and beginning to use it the Customer agrees to these Terms & Conditions.
SpaceCDN is the part of INXY.HOSTING project.
Customer – any individual or company that uses the Services of INXY.HOSTING.
Parties – group name of INXY.HOSTING and Customer
Service – means any kind of service that is officially provided by INXY.HOSTING, be it dedicated server, CDN or other IT service.
INXY.HOSTING websites – the website located at addresses www.inxy.hosting, www.inxyhost.com and www.spacecdn.com
Service Period – the period during which INXY.HOSTING provides the Customer with the project.
By registering on Inxy.hosting you get single access with your credentials to whole INXY platform, including INXY Subscription Service and any other services that are part of unified INXY platform.
Having registered, you give permission to use your safely stored login credentials for all above mentioned services.
Service period means the period of time during which the Customer uses INXY.HOSTING services, if such period is agreed beforehand and is stated explicitly in Internet Services Agreement or Order Form.
These Terms and Conditions cover only content and functionality that is provided on the INXY.HOSTING websites and do not cover any third party services. INXY.HOSTING is ready to provide the Customer the Services and both parties have to agree on specifications. INXY.HOSTING makes sure that it supplies Customer with Services in the shortest time possible.
INXY.HOSTING is not responsible in any way for the loss of profit of Customers, any other economic loss, caused by direct or indirect use of INXY.HOSTING Website, downloaded items from it, proceeding to other websites from links of INXY.HOSTING Website, and also caused by INXY.HOSTING website downtimes or inability of Customers to access the INXY.HOSTING website as well as possible inaccurate or outdated information that may be found on INXY.HOSTING Websites.
INXY Ltd gives full responsibility for conducted activity to Customer, however carefully checks that the use of services is acceptable. If you are not sure that planned activity is a misuse or violation of hosting rules, please contact support@inxy.com.
Customer is fully responsible for provided content on hosting and agrees to use services according to all applicable laws.
Illegal activities include, but are not limited to:
The party who is engaged in abovementioned or other illegal activity, may be suspended from INXY Ltd services temporarily or permanently, depending on exact breach.
INXY Ltd. has the right to deny or suspend services without refunds for such activities. INXY Ltd. also reserves the right to restrict or suspend VPN, Proxy or TOR services.
INXY Ltd. can conduct its own investigation on received complaints, including a no-consent examination of material on INXY Ltd. servers.
INXY Ltd. may pass user information to legal entities requiring it, if the applicable law requires it.
All INXY.HOSTING Websites are supplied “as is”, so the use of them is coming without condition and warranty from INXY.HOSTING. Therefore INXY.HOSTING does not guarantee that the Websites will operate without any interruptions and will be error-free as well as all the information located on INXY.HOSTING Websites is always accurate and complete. Kindly include within policy a 14-day refund period in compliance with European law.
All INXY.HOSTING Websites are supplied “as is”, so the use of them is coming without condition and warranty from INXY.HOSTING. Therefore INXY.HOSTING does not guarantee that the Websites will operate without any interruptions and will be error-free as well as all the information located on INXY.HOSTING Websites is always accurate and complete.
INXY.HOSTING uses authorization system – email and password. The confidentiality of such credentials is the responsibility of the Customer. The Customer, therefore, is fully responsible to what happens under his account. It is encouraged to inform INXY.HOSTING about the fact that your password is stolen, disclosed or lost and INXY.HOSTING will reset password for you. Since the Customer obtains the login credentials from INXY.HOSTING, this means that INXY.HOSTING grants him/her unconditional access to all restricted areas that such login credentials allow to visit. The Customer is free to use all data, information and features located in those restricted areas. INXY.HOSTING retains the right to suspend the access to any or all areas for any Customer under its own consideration.By agreeing to these Terms and Conditions Customers also promise not to try to gain unauthorized access to any protected areas of Websites as well as features or information that are located in those areas. Also the Customer agrees not to use our Websites for any damage to INXY.HOSTING computer systems or networks as well as not to use bots, spiders, robots or scrapers to access INXY.HOSTING websites and have no relation to such things performed by others.
INXY.HOSTING Websites may contain links leading to third-party resources. INXY.HOSTING informs that such links are provided only for convenience purposes. Once the Customer leaves INXY.HOSTING Websites for a third-party resource INXY.HOSTING is not responsible for contents, loss or damage during the use of them. The Customer does it all at his own risk and should be guided by Terms and Conditions or similar document of those sites.
All information and database that is present on INXY.HOSTING. Websites are protected by copyright and the Customers are not entitled to use, modify, transmit, copy or publish the materials stored on the Website as well as use its elements to create new material without prior written permission of INXY.COM. All slogans, logos, names and other trademarks belong to INXY.HOSTING and cannot be used without INXY.COM consent in written form. Also, INXY.HOSTING does not grant license to any patented products or property rights if not stated clearly in any document.
Whether the Customer signed Internet Services Agreement with INXY.HOSTING or not, Cyprus and EU laws are applicable to such relationship. All disputes should therefore be solved in the courts of Cyprus if not able to be settled by the Parties.
Customer may cancel his account and refuse to use INXY.HOSTING services any time. It may be done by contacting our support team by any mean of communication – email, Skype, contact form, live chat etc. There are no charges for canceling the account, however, clients should pay everything due in full before accounts or services can be cancelled for the cancellation to be complete.There are no refunds for any canceled services or accounts, except for the trial period if the payment has been made in advance. (This rule doesn’t apply to any of reseller accounts). INXY.HOSTING doesn’t give any refunds for the remaining term of use of any service after it has been billed. If Customer doesn’t want to be billed for service in the new billing period, he must inform INXY.COM about it before new billing period (1st day of each month) starts.If you have a suspended account, do not provide payment for 3 or more billing periods and do not contact INXY.HOSTING on the matter, INXY.HOSTING may at its sole discretion permanently delete all your data from servers without being able to restore them in future. The email containing suspension reasons are sent to customer by email that has been used for registering account with INXY.HOSTING.
